Musallah usage request

Please complete the form below to request usage of the Hidaya Musallah outside of scheduled prayer times.

The Musallah can only be used outside of the school schedule. The typical school day is 8 am to 3 pm, Monday through Friday.

General rules of Musallah usage

Applicants must be over 25 years old.
Applicants will need to provide a copy of their IDs, i.e. drivers licenses/passports and proofs of address (utility bill or official letter, no older than 3 months) with their applications.
Children can participate with a responsible parent/guardian.
Children may not be left alone in the building.
Please respect others' Ibadah.
Un-Islamic or abusive behavior will not be tolerated.
The front row in the prayer hall may not be reserved.
The only accessible spaces include: the musallah, bathrooms. No visitors will be allowed on the school side.
No food is allowed in the musallah.
No non-water drinks allowed in the musallah.
Event organizer will be responsible for locking all doors, turning off all lights, and securing the facility prior to leaving.
Hidaya Academy will not be held responsible for anything lost, stolen or damaged.
If there is any damage to the Musallah during this event, the event organizer will be financially responsible for replacement and/or repair of the facility.
The Musallah reserves the right to eject any individuals without prior notice if any of the aforementioned rules are broken.
Application forms must be returned with copy of a drivers licenses/passports and one address ID that matches the drivers license/passport name (utility bill or official letter, no older than 3 months).
Hidaya Academy reserves the right to refuse or cancel an application at any time.
No unauthorized individuals or alternative activities will be allowed at your designated time without pre approval from the Hidaya board and building committee.

Release of Liability, Waiver of Claims, Indemnification & Assumption of Risk Agreement

1. Release of Liability

In consideration of being permitted to participate in the Event, Participant, on behalf of themselves and their heirs, assigns, personal representatives, and next of kin, HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE the Organization, its officers, directors, employees, volunteers, agents, sponsors, affiliates, successors, and assigns (collectively, "Released Parties") from any and all liability, claims, demands, losses, damages, costs, and expenses (including attorneys' fees) arising out of or related to:

(a) Any injury, death, disability, or property damage sustained by Participant during or in connection with the Event;

(b) Any act or omission of the Released Parties, whether negligent or otherwise, except for acts of gross negligence or willful misconduct to the extent prohibited by applicable law;

(d) The actions of other participants, third parties, or forces beyond the Organization's control.

This Release shall be effective regardless of whether the claim arises under contract, tort, statute, or any other legal theory.

2. Indemnification & Hold Harmless

Participant agrees to DEFEND, INDEMNIFY, AND HOLD HARMLESS the Released Parties from and against any and all claims, actions, suits, proceedings, liabilities, obligations, losses, damages, costs, and expenses (including reasonable attorneys' fees and court costs) brought by any third party arising out of or relating to:

(a) Participant's participation in the Event or Activities;

(b) Any negligent or wrongful act or omission by Participant;

(d) Any injury to third parties caused in whole or in part by Participant.

The Organization reserves the sole and absolute right to accept or reject any participant's application or registration for the Event at any time, for any reason or no reason, prior to commencement of the Event. Payment of any registration fee does not guarantee participation. In the event of rejection, the Organization's sole obligation is to refund any fees paid, less any non-refundable processing costs.

3. Assumption of Risk

Participant acknowledges and voluntarily assumes ALL RISKS associated with participation in the Event, including but not limited to: physical injury, illness, death, emotional distress, property damage, exposure to communicable disease, weather-related hazards, equipment failure, and the negligent acts of other participants or third parties. Participant affirms that they are physically fit and have no medical condition that would prevent safe participation, and have not been advised against such participation by a medical professional.

4. Protection from Third-Party Claims

Participant understands and agrees that the Released Parties are not responsible for, and shall have no liability arising from, any claim brought by a third party as a result of Participant's conduct during the Event. Should any third party assert a claim against the Organization arising from or related to Participant's actions or presence at the Event, Participant shall, at Participant's own expense, cooperate fully with the Organization in the defense of such claim and shall indemnify the Organization as set forth in Section 4 above.
